Terms of Service

Introduction

By adding BackupBot to your Discord server and/or using any of its features, you agree to be bound by these Terms of Service. If you don't agree to these Terms, do not use the bot.

Description of Service

BackupBot is a Discord bot that provides automated comprehensive backup functionality for Discord servers. The service creates and delivers backups of the Discord server's data, including but not limited to server information, channel structure, roles, custom emojis, and stickers.

User Eligibility

You must be at least 13 years of age to use BackupBot. If you are between the ages of 13 and the age of legal majority in your jurisdiction, you must have parental permission to use our service.

User Responsibilities

Server Management

• You are responsible for managing access to your Discord server and determining who can use BackupBot commands.
• You are responsible for selecting an appropriate log channel that is secured properly for receiving backup files.

Backup Content

• You agree not to use BackupBot to backup Discord servers that contain illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
• You are responsible for the content of your server and ensuring it complies with Discord's Terms of Service.

Account Security

• You are responsible for maintaining the security of your Discord account and Discord server.
• You acknowledge that backup files may contain sensitive server information and agree to manage these files securely.

Use Limitations

Resource Usage

• We reserve the right to limit backup frequency or file size if your usage negatively impacts service performance for other users.
• Intentional overuse or abuse of the service is prohibited by any means unless permission is granted.

Prohibited Activities

• You may not use BackupBot for any illegal purpose or in violation of any local, state, national, or international law.
• You may not attempt to reverse-engineer, decompile, or disassemble the bot.
• You may not use the bot to spam, phish, or harm others, including yourself.
• You may not jailbreak the bot.

Intellectual Property

Bot Ownership

BackupBot and all related code, features, and functionality are the exclusive property of the bot owner (Andres99).

User Content

• You retain ownership of all server content that is backed up using our service.
• By using BackupBot, you grant us permission to process, store, and transmit your server data as necessary to provide the backup service.

Service Availability and Modifications

Availability

We strive to maintain BackupBot's availability but do not guarantee that the service will be available at all times without interruption.

Modifications

• We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice.
• We may release updates or new features at our discretion.

Data Handling

Backup Storage

• Backup files are delivered to your desired log channel and/or through our CDN for larger files.
• We do not permanently store your backup files on our servers after successful delivery.

Data Security

While we implement reasonable security measures, we cannot guarantee absolute security of your data during transmission or storage.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The service is free of viruses or other harmful components
• The results of using the service will meet your requirements

Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the service
• Any bugs, viruses, trojan horses, or the like, which may be transmitted through the service by any third party

Indemnification

You agree to defend, indemnify, and hold harmless BackupBot and its developer from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your use of the service.

Third-Party Services

Our service may utilize third-party services, such as Discord API and our CDN service (cdn.backupbot.net). Use of these services is subject to their respective terms of service and privacy policies, which is beyond our control.

Termination

We may terminate or suspend your access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Iraq, without regard to its conflict of law provisions.

Updates to These Terms

We may update these Terms of Service from time to time. We will (or won't) notify users of significant changes through our Discord support server or through direct announcement in your log channel.
